Article 1 Purpose of this agreement

1. This agreement applies to users (hereinafter referred to as "Members") shall agree to this.

2. Members must use this service in accordance with the conditions set forth in this agreement. By using this service, members are deemed to have agreed to these Terms.


Article 2 Member Registration

1. This service can only be used by individuals. It cannot be used in the name of a corporation, other associations, or other organizations.

2. Sogetsu shall, in principle, provide the Service to Members for a fee.

3. Those who wish to use this service (hereinafter referred to as "applicants") shall agree to all of the contents of this agreement and apply for use of this service from a browser with a recommended environment. By this method, when a person who wishes to use this service sends the e-mail address, credit card number, nickname, and other registration information specified by Sogetsu (hereinafter referred to as "registration information") necessary for using this service to Sogetsu, Sogetsu considers that the applicant has agreed to all the provisions of this agreement, and with this, the applicant becomes a member, and the contract regarding the use of this service between Sogetsu and the member shall be established.


Article 3 Responsibilities of Members and Sogetsu

1. Members shall strictly manage their registered information under their own responsibility, and Sogetsu shall not be held responsible for any damages incurred by the member due to the use of this service for reasons other than those directly attributable to Sogetsu.

2. Any action taken using the member's e-mail address, password and credit card shall be deemed to be the action of the member, and the member shall be responsible for the consequences of such action.


Article 4 Change of registered information

In the event of any change in the registered information, the member must immediately notify Sogetsu of the change by the method prescribed by Sogetsu. The following article applies to this late notification.


Article 5 Cancellation of membership registration, etc.

If a member falls under any of the following items, Sogetsu may suspend the provision of the Service to the member or cancel the member's registration. Sogetsu is not responsible for compensating for any damages incurred by the member due to cancellation of registration, and bears no responsibility for the consequences of this. In addition, the member loses the benefit of time at the time of cancellation of registration, and must repay all payment obligations, etc. to Sogetsu that have occurred at that time.

(1) When it turns out that the member's registration information is false;

(2) When the member has neglected to fulfill his or her obligations under this agreement for three months or more, or when Sogetsu determines that the member may fail to do so.

(3) When it is discovered that the Service (including information such as content provided in the Service) has been used illegally;

(4) When it is found that the login information required for using this service has been transferred, lent or used by a third party other than the member, regardless of the member's intention or negligence.

(5) In addition to the preceding items, when the member violates or is likely to violate these terms (included when it is found that the member has violated in the past or the member's registration has been canceled).


Article 6. Viewing registration for this service

1. When a member wishes to register, add, or change viewing of content on this service (hereinafter referred to as "viewing registration, etc."), the member shall register for viewing through the procedures prescribed by Sogetsu from the recommended browser. etc. Members can view the Service specified in the viewing registration, etc., from the time they complete this viewing registration, etc. until the viewing period specified by Sogetsu expires.

2. The fee required for viewing registration, etc. is the fee displayed on the website of this service.

3. Sogetsu will not refund the fee received from the member regardless of any reasons, such as a member's operation error at the time of viewing registration, unauthorized viewing registration by a third party, mid-term cancellation, or any other reason.


Article 7 Settlement

1. The payment of the fees required for viewing registration, etc. in the preceding article shall be made by credit card, and the member shall pay the fees in accordance with the payment terms stipulated in the terms of the credit card company. If a dispute arises with a credit card company, the member shall resolve the dispute at his or her own responsibility, and the Company shall bear no responsibility.

Article 8 Cancellation

1. Members may cancel the Service at any time by going through the member page (My Account) and following the procedures prescribed by Sogetsu. In that case, Sogetsu will not refund any fees received from the member.

2. The member shall not be exempted from the obligation to pay the charges stipulated in the preceding two articles even if the contract is canceled under this article.


Article 9 Necessary equipment

1. Installation of equipment (including hardware and software) necessary for using this service, conclusion of contracts with telecommunications carriers necessary for Internet connection, setting, maintenance and management thereof are the responsibility and responsibility of the member himself. and Sogetsu is not obligated to bear any of this. The recommended environment required for using this service is as follows.

2. Even if you use it under the recommended environment, display and function problems may occur depending on the combination of OS and browser, and browser settings. Sogetsu does not take any responsibility for such malfunctions.


Article 10 Suspension, Suspension and Abolition of the Service

1. Members acknowledge in advance that all or part of the Service may be suspended or suspended at the discretion of Sogetsu when any of the events set forth in the following items occur. Sogetsu will not be held responsible for any damages incurred by members due to such reasons.

(1) Regular or urgent maintenance and inspection of the Service;

(2) When external organizations connected to the Service, such as data center operators, communication line operators, and other telecommunications operators, regularly or urgently perform maintenance and inspections, or when a failure occurs.

(3) When the Service cannot be provided due to fire, power outage, natural disaster, or other force majeure;

(4) Inability to provide the Service due to defective hardware or software for providing the Service, unauthorized access or attack from a third party, infection with a computer virus, etc.

(5) When the provision of the Service becomes impossible due to measures based on laws, regulations, etc.

2. If Sogetsu suspends or suspends the provision of the Service pursuant to the preceding paragraph, Sogetsu will, in principle, notify the member to that effect by displaying it on Sogetsu's website or sending an e-mail at least three business days in advance. However, this shall not apply in case of emergency.

3. Sogetsu may discontinue part or all of the Service for the convenience of Sogetsu. However, when discontinuing this service, we will notify you to that effect by the method specified in the preceding paragraph at least one month before the date of discontinuation.

4. Regardless of the reason, such as cancellation or cancellation, when the use of this service ends, Sogetsu will immediately stop providing this service and delete all member data etc. recorded in Sogetsu. increase.


Article 11 Prohibited Matters

Sogetsu prohibits its members from engaging in the following acts.

(1) Modifying, analyzing, duplicating, etc. of the Service and the content provided by the Service, or of any copyrights, related rights, moral rights, portrait rights, or other trademark rights of the Company or a third party. Acts that infringe on rights such as intellectual property rights and ownership rights;

(2) Assigning or lending the right to use the Service, or transferring rights and obligations to a third party;

(3) Acts that cause disadvantage or damage to Sogetsu or a third party, and acts that interfere with the operation of this service;

(4) Illegal acts including violation of public order and morals;

(5) Ethnic or racist behavior;

(6) Acts of registering false information when applying for use of this service, viewing registration, etc.;

(7) Any act of using or allowing the use of the Service for commercial purposes;


Article 12 Intellectual property rights

All intellectual property rights and proprietary rights such as copyrights, related rights, moral rights of authors, portrait rights, and other trademark rights of all content provided by this service are licensed by Sogetsu or Sogetsu. belongs to the third party that received the Members may only use the content, etc. for the purpose of viewing in accordance with these Terms, and may not use it beyond this by duplicating, selling, lending, publicly transmitting (including making transmittable), screening, altering, adapting, or any other method.


Article 13 Protection of personal information

1. Sogetsu shall handle personal information of members (hereinafter referred to as "personal information") obtained in the course of providing this service in accordance with the Personal Information Protection Law and Sogetsu's privacy policy. Based on which this will be used for the purposes set forth in the following items.

(1) Provision of this service (maintenance information of this service, supplementary information of contents, advertisement from this foundation to members), communication, distribution of e-mail magazines, provision of information on products and services, implementation of questionnaires, accounting audit, to charge usage fees to members using the service for the above confirmation work, etc.

(2) To respond to inquiries, requests, etc., and to send requested materials, etc.

(3) To help improve the Service and develop new services

2. Sogetsu will not use personal information beyond the scope necessary to provide this service.

3. Personal information collected by Sogetsu will not be disclosed to third parties without the prior consent of the person concerned. However, in the following cases, we may disclose to third parties.

7. If a dispute arises with a third party due to leakage, loss, damage, etc. of personal information due to reasons attributable to the member, the member shall settle the dispute at its own expense and responsibility. Sogetsu does not assume any responsibility.

8. After the member cancels the service, the handling of the member's personal information shall be in accordance with Sogetsu's privacy policy.


Article 14 About cookies

Cookies are information such as usage records that are sent from the server to the user and stored as a file on the user's computer for the effective operation of the Internet. Cookies may be sent and received in order to customize the website according to needs and to improve the content of the website and the services provided so that members can be more satisfied.


Article 15 Changes to Terms

1. Sogetsu may change the name of the Service and all or part of the Terms at any time without the prior consent of the Member.

2. When Sogetsu changes the terms of the preceding paragraph, it shall be posted on the website of this service, and after that, when the member continues to use this service, the member agrees to the changed or revised terms. regarded as a thing.


Article 16 Disclaimer

Sogetsu does not guarantee any of the following items to its members, nor is it responsible for damages suffered by members or third parties, whether direct or indirect.

(1) Accuracy and truthfulness of contents and advertisements distributed by this service

(2) Resolution of all disputes, claims, etc. with other members

(3) All matters related to transactions between members and credit card companies


Article 17 Others

The Terms shall be governed by and construed in accordance with the laws and regulations of Japan, and disputes relating to the Service and the Terms shall be subject to the exclusive jurisdiction of the Tokyo Summary Court or the Tokyo District Court as the court of first instance, depending on the amount in dispute.
